Welcome to McFlyyy. These Terms of Service ("Terms") govern your access to and use of www.mcflyyy.com (the "Site") and your purchase or use of products and services offered through McFlyyy.

By accessing the Site, creating an account, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. ABOUT MCFLYYY

McFlyyy is a clothing, streetwear, accessories, and lifestyle brand based in Indiana, United States.

2. ELIGIBILITY

You may use our Site and purchase our products if you are legally able to enter into a binding agreement.

If you are under the age of majority where you live, you may use the Site and make purchases only with the permission and supervision of a parent or legal guardian.

By allowing a minor to use the Site, the parent or legal guardian accepts responsibility for the minor's use of the Site and purchases made through it.

4. PRODUCTS

McFlyyy sells clothing, streetwear, accessories, and related merchandise.

We make reasonable efforts to display product descriptions, colors, photographs, sizing, and other information accurately.

However, colors and appearance may vary depending on lighting, photography, manufacturing differences, and the display settings of your device.

Minor differences that do not materially affect the product may not constitute a defect.

Product availability is not guaranteed.

5. PRICING

Prices are displayed on the Site and may change without notice.

Applicable taxes, shipping charges, customs duties, import taxes, or other charges may be added to your order where required.

We reserve the right to correct pricing, description, or other errors.

If an error materially affects an order you have already placed, we may contact you regarding the issue and, where appropriate, cancel and refund the affected order.

6. ORDERS

Submitting an order does not necessarily guarantee acceptance.

We reserve the right, subject to applicable law, to refuse or cancel an order for reasons including:

  • Suspected fraud or unauthorized payment activity;

  • Incorrect pricing or product information;

  • Product unavailability;

  • Violation of these Terms;

  • Suspected resale or other activity that could harm McFlyyy or our customers.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

7. PAYMENT

You agree to provide accurate and authorized payment information when making a purchase.

Payments may be processed by third-party payment processors. Your use of those payment services may also be subject to the payment provider's terms and privacy practices.

You may not use payment information that you do not have authorization to use.

8. SHIPPING

McFlyyy may offer shipping within the United States and internationally.

Shipping costs and available shipping methods may vary depending on the destination and will generally be displayed during checkout.

Delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.

Delivery times can be affected by carriers, weather, customs processing, international transportation, holidays, high order volume, and circumstances outside McFlyyy's reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

International customers may be responsible for customs duties, import taxes, brokerage charges, or other fees imposed by their country or local authorities unless otherwise stated during checkout.

9. FINAL SALES, RETURNS & REFUNDS

Unless otherwise required by applicable law or expressly stated by McFlyyy, all sales are final.

McFlyyy does not generally provide refunds or accept returns because a customer changes their mind.

Exceptions may be available for:

Damaged, defective, or incorrect items: If your order arrives damaged, materially defective, or you receive an item different from what you ordered, contact us within 14 days of delivery.

Size exchanges: You may request a size exchange within 14 days of delivery, subject to product availability and the conditions below.

10. SIZE EXCHANGES

Size exchanges are subject to availability.

Unless the item arrived damaged or defective, items submitted for a size exchange must generally be:

  • Unworn;

  • Unwashed;

  • Unaltered;

  • Free from stains, odors, damage, or signs of use; and

  • Returned with original tags and packaging when reasonably applicable.

If the requested replacement size is unavailable, McFlyyy may offer another available option where appropriate.

We reserve the right to reject an exchange if the returned item does not meet these requirements, subject to applicable law.

11. DAMAGED, DEFECTIVE OR INCORRECT ITEMS

If you receive a damaged, defective, or incorrect item, contact marleymcflyyy@outlook.com within 14 days of delivery.

We may request your order number and photographs or other reasonable information showing the issue.

After reviewing the request, McFlyyy may provide an appropriate remedy, such as a replacement, exchange, or refund, depending on the circumstances and applicable law.

Nothing in these Terms eliminates rights or remedies that cannot legally be waived.

12. LOST OR DELAYED PACKAGES

Once an order is transferred to a shipping carrier, delivery may be affected by circumstances outside our control.

If your tracking information indicates a problem, contact us and/or the applicable carrier so the issue can be investigated.

Nothing in this section limits any responsibility McFlyyy may have under applicable consumer-protection law.

13. INTERNATIONAL ORDERS

Customers ordering outside the United States are responsible for complying with the laws and import requirements of their destination.

Customs agencies may delay, inspect, or assess charges on international shipments.

Unless otherwise stated at checkout or required by law, customers are responsible for applicable import duties, taxes, customs charges, and related fees.

14. INTELLECTUAL PROPERTY

Unless otherwise indicated, the McFlyyy name, branding, logos, original graphics, product designs, photographs, videos, website content, text, artwork, and other original materials displayed on the Site are owned by or licensed to McFlyyy and are protected by applicable intellectual-property laws.

You may not reproduce, sell, distribute, modify, commercially exploit, or use McFlyyy's protected materials without authorization, except where permitted by law.

Purchasing a McFlyyy product does not transfer ownership of McFlyyy's intellectual-property rights to you.

15. ACCEPTABLE USE

You agree not to misuse the Site.

You may not knowingly:

  • Attempt to gain unauthorized access to the Site or another customer's account;

  • Introduce malware or malicious code;

  • Interfere with the Site's operation or security;

  • Use automated systems to abuse purchasing systems or overwhelm the Site;

  • Engage in fraudulent transactions;

  • Impersonate another person;

  • Use the Site for unlawful purposes; or

  • Infringe the intellectual-property or other legal rights of McFlyyy or another person.

McFlyyy does not control every third-party service and is not responsible for third-party websites or services except to the extent required by applicable law.

Your interaction with a third party may be governed by that third party's own terms and policies.

17. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may be subject to additional conditions.

Unless otherwise stated, promotions may not be combined, exchanged for cash, or applied retroactively.

McFlyyy may modify or end promotions subject to applicable law.

Fraudulent or unauthorized use of promotional offers may result in cancellation of the applicable order or promotion.

18. WEBSITE AVAILABILITY

We aim to keep McFlyyy.com available and functioning properly, but uninterrupted access cannot be guaranteed.

The Site may occasionally be unavailable because of maintenance, technical problems, updates, security concerns, or circumstances outside our reasonable control.

19. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Site and its content are provided on an "as is" and "as available" basis.

McFlyyy does not guarantee that the Site will always be uninterrupted, completely error-free, or free from every harmful component.

This section does not exclude warranties or consumer rights that cannot legally be excluded.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, McFlyyy will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from your use of the Site or products.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

21. FRAUD AND CHARGEBACKS

If you believe there is a problem with an order, please contact us so we have an opportunity to investigate and resolve the issue.

McFlyyy reserves the right to dispute fraudulent or abusive chargebacks and provide relevant transaction, shipping, communication, and account information to payment processors, banks, or other parties involved in resolving a payment dispute, subject to applicable privacy laws.

Nothing in these Terms restricts a customer's lawful right to dispute an unauthorized or otherwise validly disputable transaction.

22. PRIVACY

Your use of McFlyyy.com may also be governed by our Privacy Policy.

The Privacy Policy should explain how McFlyyy collects, uses, stores, and shares personal information associated with website visits, accounts, purchases, and other interactions.

23. CHANGES TO THESE TERMS

McFlyyy may update these Terms from time to time.

When we make changes, we may update the "Last Updated" date at the top of this page.

Changes will apply as permitted by applicable law. Material changes will not be applied retroactively where doing so would be prohibited.

24. GOVERNING LAW

These Terms are governed by the laws of the State of Indiana and applicable federal laws of the United States, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.

Customers outside Indiana or outside the United States may have additional rights under the laws that apply to them.

25. SEVERABILITY

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

26. ENTIRE AGREEMENT

These Terms, together with any policies or terms expressly incorporated into them, constitute the agreement between you and McFlyyy regarding your use of the Site and purchases made through it.
